Website Terms and Booking Conditions

Welcome to Nottage Escapes.
Nottage Escapes is a registered business name of Possum View Enterprises Pty Ltd (ABN 68 159 459 560).
These Terms and Conditions apply when you:
- Visit or use www.nottageescapes.com.au.
- Submit an enquiry.
- Make a direct booking with Nottage Escapes.
- Stay at a property managed by Nottage Escapes.
- Use any service offered through our website.
By using our website or making a booking, you agree to these Terms and Conditions. If you make a booking on behalf of other guests, you must ensure they are aware of and comply with these terms and the applicable property rules.
1. Definitions
In these Terms and Conditions:
- “Guest”, “you” or “your” means the person making the booking and all occupants and visitors associated with that booking.
- “Nottage Escapes”, “we”, “us” or “our” means Possum View Enterprises Pty Ltd trading as Nottage Escapes.
- “Property” means the holiday accommodation identified in your booking.
- “Booking confirmation” means the confirmation issued after a booking has been accepted.
- “Property rules” means the house rules, instructions and restrictions shown on the property listing, booking confirmation or at the property.
2. Our role
Nottage Escapes provides accommodation booking and short-stay property management services. We may manage a property and accept bookings as an authorised agent for its owner.
The property, booking dates, price, cancellation policy and included services will be identified in the listing and booking confirmation.
3. Booking eligibility
The person making a booking must:
- Be at least 18 years old.
- Have the legal authority to enter into the booking.
- Provide accurate and complete information.
- Be authorised to use the selected payment method.
- Accept responsibility for the conduct of all guests and visitors.
We may request reasonable identification or booking verification before check-in. If required verification is not provided, we may be unable to confirm or continue the booking.
4. Booking confirmation
A booking is not confirmed until:
- We or the relevant booking platform accept it;
- The required payment has been received or authorised; and
- A booking confirmation has been issued.
Guests should check their confirmation carefully and contact us promptly if any information is incorrect.
Special requests are subject to availability and are not guaranteed unless confirmed by us in writing.
5. Prices and payment
All prices are displayed in Australian dollars and include GST where applicable.
The total price, deposit, payment schedule and any compulsory charges will be disclosed before the booking is completed.
You authorise us or our payment provider to charge the nominated payment method for:
- The booking amount and disclosed fees.
- Approved booking changes.
- A security deposit or bond where disclosed.
- Reasonable costs resulting from damage, missing items, lost keys, excessive cleaning or another breach of these terms.
We will provide details of additional charges and supporting information where reasonably available. You may contact us if you wish to dispute a charge.
6. Cancellation by the guest
Unless a different cancellation policy is clearly displayed before booking and included in your confirmation, the following policy applies to direct bookings:
- Cancellation at least 14 days before the scheduled arrival date: 100% refund.
- Cancellation at least seven days but fewer than 14 days before arrival: 50% refund.
- Cancellation fewer than seven days before arrival: no refund.
No refund will ordinarily be provided for a no-show, late arrival, early departure or change of mind within the non-refundable period.
If you booked through Airbnb or another third-party platform, the cancellation and refund rules displayed on that platform at the time of booking will apply. Any fees retained by the platform are governed by its terms.
Nothing in this section limits any refund or remedy available under the Australian Consumer Law.
7. Changes to a booking
Requests to change dates, guest numbers or other booking details are subject to availability and approval.
A change may affect the booking price. If a requested change cannot be accommodated, the original booking and its cancellation conditions will continue to apply.
Bookings cannot be transferred or resold without our written permission.
8. Cancellation or changes by Nottage Escapes
Occasionally, circumstances outside our reasonable control may make a property unavailable or unsuitable. These circumstances could include significant damage, an urgent safety issue, utility failure, government restriction or another unexpected event.
If we cannot provide the booked accommodation, we will contact you promptly and offer, where reasonably possible:
- Suitable alternative accommodation;
- A change of dates;
- A credit; or
- A refund for the accommodation we cannot provide.
Your rights and available remedies will depend on the circumstances and the Australian Consumer Law.
9. Check-in and check-out
Check-in and check-out times are shown in the property listing and booking confirmation. Unless otherwise stated:
- Check-in is from 3:00 pm.
- Check-out is by 11:00 am.
Early check-in and late check-out require prior written approval and may incur an additional fee.
Guests must follow the provided key, lockbox and access instructions. Lost keys, remotes or access devices may result in a reasonable replacement or call-out charge.
10. Guest numbers and visitors
The number of overnight guests must not exceed the maximum occupancy shown in the listing or booking confirmation.
Only registered guests may stay overnight. Additional guests or visitors require prior approval where directed in the property rules.
Additional charges may apply if the approved number of guests increases. Exceeding occupancy limits may constitute a serious breach and result in termination of the stay.
11. Property rules and guest conduct
Guests must:
- Use the property only for lawful, short-term accommodation.
- Treat the property, its contents and surrounding community respectfully.
- Keep noise at a reasonable level, particularly at night.
- Follow all parking, rubbish and local council requirements.
- Comply with safety instructions and property rules.
- Secure the property when unattended.
- Notify us promptly of damage, faults, hazards or maintenance problems.
- Supervise children and any approved pets.
- Leave the property in a reasonably tidy condition.
Unless expressly approved in writing:
- Parties, functions and events are prohibited.
- Smoking and vaping inside the property are prohibited.
- Pets are prohibited unless the listing specifically states they are permitted.
- Commercial activities, filming and photography for commercial purposes are prohibited.
- Tents, caravans or additional sleeping arrangements are prohibited.
- Illegal, dangerous, disruptive or antisocial conduct is prohibited.
12. Serious breaches
We may require guests or visitors to leave the property where there is a serious or continuing breach, including:
- Violence, threats, harassment or illegal activity.
- An unauthorised party or event.
- Deliberate or reckless property damage.
- Excessive occupancy.
- Smoking inside the property.
- Keeping an unauthorised pet.
- Conduct that creates a significant safety risk.
Ongoing unreasonable noise or disturbance after a warning.
Where a stay is terminated because of a serious breach, refunds will be determined according to the circumstances, our actual loss and applicable consumer law. Guests remain responsible for reasonable costs caused by the breach.
13. Damage, additional cleaning and missing items
The booking guest is responsible for the conduct of all guests and visitors included in the booking.
You must promptly report any breakage, damage or loss. Accidental damage will be assessed reasonably and fairly.
Additional charges may apply for:
- Damage beyond reasonable wear and tear.
- Missing or removed items.
- Excessive cleaning.
- Stains, smoke or pet-related cleaning.
- Unauthorised guests, animals or events.
- Lost keys or access devices.
- Call-outs caused by a guest’s act or omission.
- Rubbish or belongings left in unreasonable quantities.
We may provide photographs, invoices, quotations or other supporting information where reasonably available.
14. Maintenance and property access
Please notify us promptly if something at the property requires attention.
We or an authorised contractor may enter the property when reasonably necessary to:
- Complete urgent repairs.
- Address a safety or security concern.
- Respond to an emergency.
- Investigate a serious suspected breach.
- Carry out agreed maintenance or services.
Reasonable notice will be provided where practicable, except in an emergency or urgent situation.
15. Facilities, safety and accessibility
Guests use the property and its facilities responsibly and must take reasonable care for their own safety.
Children must be appropriately supervised, particularly around balconies, stairs, driveways, beaches, pools, water, fireplaces or outdoor areas.
Guests should review the listing and contact us before booking if they have specific accessibility requirements. We will provide the information reasonably available to help determine whether a property is suitable.
16. Personal belongings
Guests are responsible for their personal belongings during their stay.
If an item is left behind, we will make reasonable efforts to locate it. Postage, courier and handling costs are the guest’s responsibility. Unclaimed belongings may be donated or disposed of after a reasonable period.
We are not responsible for loss, theft or damage to personal belongings unless caused by our negligence or another matter for which liability cannot legally be excluded.
Guests are encouraged to obtain suitable travel insurance.
17. Property information and availability
We take reasonable care to ensure property descriptions, photographs, prices and availability are accurate.
Minor changes may occasionally occur due to maintenance, replacement furnishings, seasonal conditions or circumstances outside our control. Please contact us before booking if a particular feature or amenity is essential to your stay.
Internet, utilities and third-party services may occasionally be interrupted. We will take reasonable steps to assist, but continuous availability cannot be guaranteed where an interruption is outside our reasonable control.
18. Australian Consumer Law
Our services come with rights and consumer guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms and Conditions excludes, restricts or modifies a right, guarantee, warranty or remedy that cannot legally be excluded.
Subject to those rights, we are not liable for loss caused by:
- A guest’s act, omission or failure to follow instructions.
- Inaccurate information supplied by a guest.
- An event outside our reasonable control.
- A third-party service provider where we have exercised reasonable care in selecting or coordinating that provider.
- Indirect or commercial loss that was not reasonably foreseeable.
19. Website use
You may use our website for lawful, personal and non-commercial purposes.
You must not:
- Use the website for unlawful, fraudulent or harmful activity.
- Attempt to gain unauthorised access to the website or its systems.
- Introduce malicious software or interfere with website operation.
- Copy, scrape or collect website content or data using automated means without permission.
- Impersonate another person or provide false information.
- Use our content or branding in a misleading way.
We may restrict access where reasonably necessary to protect the website, our users or our business.
20. Intellectual property
Unless otherwise stated, the website and its content—including text, photographs, graphics, branding, layout and logos—are owned by or licensed to Nottage Escapes.
You may view and print reasonable extracts for personal use.
You must not reproduce, republish, sell, distribute or commercially exploit website content without prior written permission.
21. Reviews and submitted content
If you submit a review, photograph or other content, you confirm that:
- You created it or have permission to provide it.
- It is accurate and not misleading.
- It does not infringe another person’s rights.
- It is not unlawful, defamatory, threatening or offensive.
You grant us a non-exclusive, royalty-free licence to use and display that content for operating and promoting our services. We will not attribute content to you beyond the permissions provided or applicable platform settings.
22. Third-party websites and platforms
Our website may contain links to third-party websites or booking platforms.
Those services are governed by their own terms and privacy policies. We are not responsible for their independent content, availability, security or conduct.
23. Privacy
We handle personal information in accordance with our Privacy Policy, available on our website.
24. Updates to these terms
We may update these Terms and Conditions when our services, website or legal obligations change.
The terms applying to an existing booking will generally be those accepted when the booking was made, unless a change is required by law or agreed with you.
25. General provisions
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure or delay in enforcing a provision does not waive the right to enforce it later.
These Terms and Conditions are governed by the laws of South Australia. The parties submit to the courts and tribunals having jurisdiction in South Australia, subject to any rights you may have under applicable consumer law.
